The credentials of Bro. R. W. Best as Representative of the Grand Orients of Brazil and New Granada, of Bro. Ellis Ma- lone as Represeatative of the Grand Lodge of i^ova Scotia^ and of Bro. D. W. Bain as Representative of the Grand Orient of Cuba, near this Grand Lodge, were presented and the brethren were cordially received.

The Grand Secretary presented tlie following as his annual report, which was read and referred to the committee on his books, except so much thereof as relates to the violation of the jurisdiction of this Grand Lodge by Lodges in JSTova Scotia, which was referred to the committee on Masonic Jurisprudence" :

To THE Most Worshipful Grand Lodge of ISTorth Carolina :

Brethren: The occasion of our assembling in another annual com- munication calls forth renewed expressions of gratitude to Him whose kind providence has, in general, attended us through one more year.

On the 4th of February last, under a commission of that date from the M. W. Grand Master, I assumed the duties of Grand Secretary, as the successor of him who had long been permitted to serve the Fraternity in that capacity.

The following report embracing the transactions of the oflSce from the last report of the Grand Secretary is respectfully presented.

By direction of the " Printing and Publishing Committee" the usual number of copies of the Proceedings of the last annual communication were printed and disposed of as follows : three copies each were trans- mitted to the Lodges in this jurisdiction one copy each to the acting and past Grand Officers two copies to some ot the Grand Lodges in the United States and Territories (in full reciprocation of a similar favor * rendered) and to others one copy also one copy to each of the foreign Grand Bodies with which we are in correspondence. There is a small residue on hand.

Owing to the want of mail facilities, many of the packages for the sub- ordinate Lodges were transmitted by such other modes as would ensure their safe delivery. Those sent by mail were directed to the post-offices of the Lodges as published in the proceedings of the Grand Lodge, but I am apprehensive that some of them failed to reach their destination owing to the discontinuance (as I subsequently learned) of a number of the offices in the State. In very few instances only was I advised of any change of office.

Proceedings from nearly all the Grand Lodges in the United States and Territories for 1866 and a few for 1867, also Monthly Bulletin and Calen- dar of the Grand Orient of France for 1867, have been received and de- livered to the committee on Foreign Correspondence.

The receipts into the Treasury during the year amounted to two thou- sand seven hundred and one Dollars and twenty five cents, and were de- rived from sources as follows :

Dues from Subordinate Lodes for 1866 and previous years, $2,183 50 Charters to Lodges less Grand Secretary's fee, 899 00

Dispensations to Lodges less Grand Secretary's fee, 102 00

Diplomas to Lodges less Grand Secretary's fee, 16 75

Total, 12701 25

This amount was paid to the Grand Treasurer for which his receipts were obtained, except $7,75 of that received for diplomas which I applied to postage purposes.

With commendable promptness the Lodges paid their dues for 1866 and in many instances arrearages for several years were liquidated.

There are a few Lodges whose dues to the Grand Lodge for three years remain unpaid, some of which will, it is probable, make application at the present communication for the remission of a portion, or the whole of this indebtedness.

The Lodges chartered at the last annual communication (twenty in number) from 240 to 260 inclusive were, as far as ascertained, duly or- ganized and have been regularly at work.

During the year dispensations for the formation. of fifteen new Lodges have been issued by the direction of the Deputy Grand Master, as follows : Feb. 4th. Excelsior Lodge^ at Charlotte, Mecklenburg County.

The last mentioned Lodge formerly existed as Mecklenburg No. 176, the charter of which was forfeited for delinquency in making returns and paying dues to the Grand Lodge for several years. Application will be made at the present communication for the restoration of its original charter.

The report of the committee on Masonic Jurisprudence and accompa- nying resolutions concerning the violation of the jurisdiction of this Grand Lodge by Lodges located at Halifax, Nova Scotia, adopted at the last annual communication, were in obedience to instructions, forwarded to the Grand Secretary of the Grand Lodge of England, with a request that they be presented to that Body for its consideration.

The lollowing reply has been received :

Sir and Brother i have the honor to acknowledge the receipt of your letter dated the 25tb of June last, together with a printed copy of the proceedings of the Grand Lodge of North Carolina held in the month of December 1866. \

In your letter you direct attention to the Report of a Committee on Masonic Jurisprudence, which is printed with proceedings of your Grand Lodge, and more particularly to a Resolution based upon the said Report.

It is alleged by the Committee that certain proceedings took place in two Lodges at Halifax, Nova Scotia which they consider highly improper and that the Lodges referred to are " working under the jurisdiction of the Grand Lodge of England."

It is unnecessary for. me to enter into the question whether one Grand Lodge has, or has not,' the right to interfere with the affairs and proceedings of Lodges holding under a different constitution, or whether the opinion expressed by a so-called Masonic Congress at Paris can have any weight with Masonic Bodies who were not there represented and who have no official knowledge of what took place. It will perhaps suffice at present to say that neither the " Athol Lodge, No. 65," nor the "Keith Lodge, No* 86 or 61" hold warrants from, or have any connection whatever direct or indirect with the Grand Lodge of England. I trust therefore to your impartiality to give as public a contradiction to the charge that your Committee have brought forward, and which has been adopted by your Grand Lodge, as you have given to the very incorrect statement so far at least as the Grand Lodge of England is concerned.

The M. W. Grand Master has directed the Colonial Board to take this charge against his Grand Lodge into consideration to report thereon at the next quarterly Communication which will be held on the 4th of De- cember. I have the honor to be

Until the organization of the Grand Lodge of Nova Scotia in 1866, the Lodges in that Province existed under the authority of two separate and distinct Grand Lodges, to wit : England and Scotland. Others working under the jurisdiction of the Grand Lod^e of Ireland have ceased to exist within a few years past.

The two Lodges referred to in the report of the committee, viz : Athol^ Ko. 361 and Keith, No. 365 were under the Grand Lodge of Scotland. Under the organization of the Grand Lodge of Nova Scotia, their num- numbers are respectively 2 and 3.

In April last I received a communication from Bro. Andres Cassard of the City of New York, General Representative of several foreign Grand Bodies, suggesting the establishment of fraternal relations by an exchange of Representatives between this and those Bodies, which was transmitt- ed to our M. W. Grand Master, who expressed his approval of the propo* sition. Credentials were accordingly forwarded to the following breth- ren as Representatives of this Grand Lodge near their respective Bodies, agreeably to the recommendation of Bro. Cassard :

Brethren in this jurisdiction have been designated as Representatives for these Bodies near this Grand Lodge, and will, it is presumed, present their credentials.

The Grand Lodge is indebted to R. W. Bro. Charles A. Fuller, Grand Secretary of the Grand Lodge of Tennessee, for a copy of a " Masonic Text Book," a work prepared for the use of the craft in that jurisdiction and approved by the Grand Lodge.

A^so to R. W. Bros. Wm. Hacker Grand Secretary of the Grand Lodge of Indiana, and Hugh A. Corley, Grand Secretary of the Grand Lodge of Florida, for bound volumes of the proceedings of their Grand Lodges— the former from 1817 (the date of its organization) to 1845 and the latter from J 860 to 1866.

By such acts of kindness on the part of brethren throughout the country, our small though valuable library of Masonic works continues to increase.

One case of the removal of a Lodge, occurred during the year, viz; Lenoir, No. 233, from Lenior Institute, Lenoir county, toMoselej Hall of same county. Sec. B8th, of Art. 4th ot the By-Laws of the Grand Lodge in relation to removals, was in general, complied with.

they may deem proper, in submitting a partial report, beg leave to state, that they have been utterly unable to devote to that work, the time and labor necessary to collect and classify the material, review the authorities and prepare such a digest, as they would feel justified in presenting to the Grand Lodge. Such a work would manifestly prove of great ad- vantage to the craft, and the committee regret exceedingly, that it has not been possible for them to complete that portion of the duty as- signed them, within the prescribed time.

Your committee have carefully revised the By Laws, and incorporated into the code herewith submitted the substance of the various new regu- lations that have been adopted from time to time, and are now in force ; so far as they have been able to find them among the standing Resolu- tions of the Grand Lodge. They therefore recommend, should the By Laws herewith submitted be adopted, that in reprinting the standing Resolutions, the following should be dropped from the list, viz :

Your Committee respectfally recommend that all standing Resolutions not herein enumerated, or that shall not be repealed or rescinded at this Grand Communication, together with such new regulations as may here- after be adopted, be classified and numbered ; and that they be printed with the proceedings of each annual communication, striking from the list such as may from time to time be rescinded or altered, thus rendering them accessible to the Subordinate Lodges at all times, as a guide for their action. ^

Your committee believe that there is a large majority of the Lodges in this Grand jurisdiction, whose By-Laws, as they now stand, have never been appoved by this Grand Lodge. Having been once approved, they have been amended or altered from time to time, perhaps in many im- portant particulars, without ever having obtained the sanction of the Grand Lodge to such amendments or alterations.

They also submit that the time which the committee on charters and Dispensations, can devote during the convocation to the examination of the By-Laws usually placed in their hands, is insuiiicient for that critical examination that should be bestowed upon a matter of so much impor- tance. They therefore recommend the following additions to Article four of the By-Laws of the Grand Lodge, viz :

Sec. 38. The By-Laws of all Lodges working under Dispensation, shall be forwarded to the chairman of the committee on Jurisprudence at least two months preceding the application of such Lodge for a char- ter, for his examination, and such alterations as he may direct, must be made, and the By-Laws approved by said committee before they can be submitted to the Grand Lodge through the committee on Charters and Dispensations.

Sec. 39. No Lodge shall proceed to act under any By-Law, until it shall have been approved by the chairman of the committee on Juris-

prudence, whose duty it shall be to submit all By-Laws approved by him, to the next succeeding Grand Communication, and if not confirmed, they shall be rescinded by the Lodge at the next succeeding regular meeting after receiving notice thereof.

Your committee believe that much delay and consequent inconven- ience to the subordinate Lodges may be avoided, and the By-Laws much more thoroughly examined by thus placing them in the hands of the committee on Jurisprudence, which they conceive to be the appro- priate committee to determine whether the Subordinate Lodges conform to the laws, rules and regulations of the G-rand Lodge, or not.

You committee believe that every new Lodge should be required to "work under Dispensation for six months at least before a charter should be granted, and that even twelve months might be exacted with advantage to such Lodges and to the craft. That length of time would doubtless enable them to determine whether or not the Lodge would be sustained The committee therefore propose to substitute for Sec. 8, of Art. 3, of the By Laws, the following, viz :

Sec. 8. Every Lodge working under a Dispensation shall return the same to the Grand Lodge, at the first annual communication after the expiration of six months, from the date of such dispensation, together with a copy of the By-Law&, which they may propose to adopt, a trans- cript of their proceedings, a list of officers, and a fee of twenty dollars, ■and in addition thereto, a sufficient sura to pay for a suitable seal, for which a charter and seal shall be issued if so ordered by the Grand Lodge. And the Secretary of every charterd Lodge shall attach the seal thereof to all communications issued by order of the Lodge.

Your committe entertain the opinion that members of a regular Lodge who wish to assist in the establishment of a new Lodge, should not be required to demit until the new Lodge shall have obtained a Charter, and then only, in case they wish to become members of the new Lodge, ■and therefore recommend that the 5th resolution of the series of 1860 be repealed. They would also call attention to the fact, that in the last printed constitution, the amendment of Sec. S of Art 7, has not been made, as directed in Resolutions of 1859, and recommend that the amend- ment be made, and the Resolution dropped from the list.

Your Committee regret, that in the work assigned them, they could not have had the able counsel of their chairman.

Sir and Bro : Upon the receipt of your Commission under date of 5th December 1866, confering upon me the office of Grand Lecturer, for the State ^t large, I immediately entered upon the work of preparing my- self for the proper discharge of that important duty, and on the 21st of February last, I communicated to you the fact that I was then prepared to instruct the Grand Lecturers in the work, and suggested that you should communicate this information to each of them, and if any could not, or would not come, to endeavor to procure the services of others who would do so.

I regret exceedingly that the whole number conld not have qualified,- and been actually employed in their respective Circuits ; though I fear that there are a large majority of the Lodges that have not the necessary means to compensate a Grand Lecturer for his services. I look upon it as utterly useless for the Grand Lodge to make any further efl:brts to pro- vide her subordinates with teachers, until she shall have determined what the work shall be, and forbidden the practice of any other.

munication. I herewith send you a statement of what I have done this year. In July last I visited Holly Grove Lodge, 252, in Gates county, and am pleased to say that I found their work and proceedings in a better condition and more correct than any new Lodge that I have ever at- tended, and. after staying with them one week, I left them working well. The craft is in good hands and the W. Master is the right man in the right place. I have also visited Jordan Lodge, No. 184; Gates ville Lodge Ko. 126 ; Atlantic Lodge, No. 238 ; Charity Lodge, No. 5 ; and Widow's Son Lodge, No. 75, and have left them all greatly improved in the work and Lectures of the three degrees of Masonry. The rest of the Lodges in my District I have written to, but as yet have had no call to lecture them. I hope soon, if I should be continued as Lecturer, to visit them and instruct them in the work. The Brethren in the Lodges that I have vis- ited are very anxious for more light, and as soon as their situation will justify it, I am convinced that they will use every means in their power to procure the information they so much desire.

M. W. Sir und Brother: I received a commission from R. W. Robert W. Best, Deputy Grand Master, bearing date August 1st, 1867, appoint- itig me Lecturer of the Lodges in the third Judicial Circuit. Early in the month of September, I gave the Lodges notice of my appointment, and that I would be pleased to receive a call from such of them as might require my services-. Since which time, I have been called to, and have visited the following Lodges to wit :

Hiram Lodge, No. 40 ; William G^ Hill Lodge, No, 218 ; Anchor* Lodge, No. 234 ; Granite Lodge, No. 191 ^ Johnston Caswell Lodge, Iso. 10; Holly Springs Lodge, No. 115; William T. Bain Lodge, No. 231 ; and Carey Lodge, No. 198. Most of these Lodges stood in much need of instruction, and I believe my visit to them has materially improved their capacity for work. The Brethren have generally shown an earnest desire for "more light," but it being a busy season of the year with farmers, many of them were prevented from attending the lectures regularly, and they did not derive as much benefit from them as they otherwise Would have done. My stay with Johnston Caswell Lodge was cut short, Dwing to the Worshipful Master being called from home on business the second day after my arrival and by the Wardens being so much occupied in business that they could not spare the time to get up the work Whik tiiere I raised two craftsmen to the sublime degree of M, M,

Ih my intercourse with the brethren of all the Lodges I have visited. I have been treated with the utmost kindness and most profound respect, and my only regret is, that I have not been enabled to impart to them more light than they have received.

Seeing that the Grand Lodge had adopted the work as- taught by mCy and having taught said work to Bro. Alfred Martin, and it being deemed therefore unnecessary by the Deputy Grand Master, I did not apply to Bro. Martin for a certificate, as I designed teaching the same work which I had taught him. Agreeably to an established Custom of this- Grand Lodge, I herewith submit my annual repart as Grand Lecturer, for the 5th Judicial Circuits

In March, by special invitation', I visited Concord Lodge, Ko. 58, ai Tarbora, and found a majority of members luke- warm and indifferent. There were few noble spirits-,, however,, who had determined to sustain the Lodge, at all hazards, and who were indefatigable in their labors and studies, and made rapid progress. I visited them again in May, and was glad to- find so much interest manifested, and s'o large an" attendance from day to day. The indifference had entirely disappeared, and they all manifested much interest and concern for the well being of the craft. I remained with them until they were well instructed in the work, and it gives me great pleasure to- say, that the Lodge is in a flourishing con- dition and works well.

In August, I visited Cape Fear Lodge, Ko. 194, at Elizabethtown, and found the Brethren zealous, and anxious for light. There was a goodly number who attended the lectures daily, and seemed anxious to learn. Their minutes were kept tolerably well, but their finances were very much deranged. I visited them again in- October ami found their Com- mittees busily engaged in balancing the accounts, and I have no doubt that ere this their financial troubles have disaj>peared, and that the- Lodge will go forward to prosperity and usefulness.

In September, I visited St. Alban's Lodge, No. 114, at Lumberton, and found them working very creditably, and from the interest manifested,, and the incessant labor of the officers to acqnire the work,— I have no* doubt that it is one of the best working Lodges in the State.

I visited Mt. Olive Lodge, l^o. 208. at Mt. Olive, and found them work- ing badly. The Brethren are good Masons, all seemed anxious to Teartt,. and some of them acquired considerable of the work for the short tim©'

I remained with them. I think, in time, this will become a very useful Lodge, if the Brethren become not weary in well doing.

On the 28th of October, I visited Mill Greek Lodge, No. 125, in John- son county, and met a band of good and true Masons. I regret that so few of them can work. Some of them improved the time I spent with them, and I hope the Master will find them more useful in the several Degrees than heretofore.

From Mill Creek, I went to Mingo Lodge, Ko. 206, in Sampson county. This Lodge was not working well, the Brethren, however, were very zealous and attended the Lectures regularly, and made considerable im- provement. They will doubtless persevere until they become proficient in the work.

On the 17th of November,. I was at Averasboro, and met the Brethren of Palmyra Lodge, No. 147, who had been instructed by Bro. Dunkley, tmd found them following his work very closely, I remained with them several days, and believe they learned the work correctly.

Most of these Lodges are very poor, being scarcely able to pay the ex- penses of the Grand Lecturer. Their quarterly dues are only twenty- fi-ve cents, and some of them have not collected this small pittance for several years. There was not one of the Lodges visited, that had com- plied with the Law of this Grand Lodge, in regard to the proficiency of Candidates -'to be manifested in open Lodge." This is a serious matter ; for how can a Lodge perpetuate itself unless it instruct its Apprentices and Fellow- crafts. We all know by experience, that the proper time to learn the first Degree, is before we have taken the second, and the same may be said of the Fellow crafts before they are made Masters. I hope this Grand Lodge will pass a resolution prohibiting the Lodges, under its Jurisdiction, from passing any candidate, who cannot answer all the ■questions in the first section of the E. A. Degree ; and from raising any candidate who cannot work himsqlf through the first and second sections of the Fellow-craft's Degree, into the Middle Chamber. I regret that it becomes my duty to report Black Rock Lodge, No. 135, for a breach of Masonic Law and courtesy, under the following circumstances :

St. John's Lodge, No. 1, rejected the petition of Mr. B., who contin- ued to reside in Wilmington, for some time afterward. He then removed within the Jurisdiction of Black Rock Lodge, and petitioned that Lodge for the Degrees before he had been one year in the neighborhood This petition was entertained, and he was elected and initiated. My at- tention having been called to these facts, I sent a message to the Lodge, informing them, that they had proceeded illegally, and advised them to withhold the remaing degrees ; they delayed action and sent a message to St. John's Lodge, asking their consent to have the remaining de-

grees conferred, which they were compelled to decline, on the ground that they could not consent to an illegal act, and furthermore, that the candidate was repugnant to the members of St. John's Lodge, and that they were unwilling to affiliate wath him. After all this they called an emergent meeting, and passed and raised him the same day, I have received a message from the officers of Black Rock Lodge, regretting the course thus pursued in this matter, and promising never to do so again. There are a great many Lodges working up rejected material. Might I suggest to the committee oa Jurisprudence, the propriety of framing a law prohibiting them from doing so, without the unanimous consent of the Lodge who rejected it, and of reporting a resolution, whereby the Lodges may know when such material offers, either by having it expres- sed in the petition, or adding one more question to the three now asked the candidate before his initiation.

I received such a number of invitations during the last three months that it was impossible for me to visit them all. There is a great desire manifested in my district, for further light, and I hope ere long, the Breth- ren will be gratified. It has been a matter of pride with me to have the brightest and best informed district in the State, but it requires " time, patience and perseverance," and with these it will be accomplished. I have visited Pythagoras Lodge, No. 249, at Smithville several times du- ring the year, and I unhesitatingly say that it is the brightest and best governed young Lodge I ever saw or heard of. Of St. John's Lodge, Ko 1, it does not become me to speak. I may be pardoned, however, for saying, that I am proud of it. All of which is fraternally submitted.

Shortly after the last Grand Communication, I received my appoint- ment as Grand Lecturer of the 8th Judicial Circuit. Not long thereafter, Bro. Martin requested me to come to Wilmington and perfect myself in the work and lectures, which I was exceedingly anxious to do, but owing to the great distance to be travelled over, and other difficulties, I was , not able to visit Bro. Martin till last week. I received urgent invitations from Junaluskee, Burnsville, Mt. Pisgah and other Lodges in the Circuit, to visit them, but not feeling at liberty to instruct those Lodges fully, for the want of Bro. Martin's certificate, and feeling also that I could not sufficiently call to mind, the work as formerly received from Bro. Martin, I declined to lecture before them until I should receive further light.

In the meantime Bro. Murdock of the 6th District, visited Asheville, with whom I had a short interview, and from the information obtained from him, I gave several of the Lodges, Bro. Martin's work in opening and closing. By special authority of the most W. G. M., I consecrated and dedicated Waynesville Lodge, No. 259, on the 18th of Nov., and by invitation delivered a public address before the brethren and citizens of that place. My intercourse with the brethren, in the Lodges beyond the mountains, has been of the most delightful character. They are anxious ' for more light, and desire that the Stevenson work, as now practiced and taught by Bro, Martin, be continued without further change.

Twelve years ago I was appointed by P. G. Master Jordan, Grand Historian of Masonry in the State. The G. L has paid all travelling ex- penses incurred. The work will make a book of 400 or 500 pages. I have devoted much time to its preparation. I am willing to give up the work to the Grand Lodge, or publish it on my own account. The work has been supervised by Bros. French, Blake, Lander and Campbell, a committee appointed by the Grand Lodge, and has met their appro- val, and a portion was read to the Grand Lodge.

In the event of publishing an my own account, I desire to retain my title of Grand Historian of the Grand Lodge of North Carolina.

The resolution introduced on last night was to me unexpected, but I take pleasure in saying, the Book is dedicated to P. G. M., Jordan and Bro W. K. Blake, the parties who had me appointed to t&e office. The war has prevented my announcing the book ready for publication, but I hope to have it published during the spring, and will expect the Craft to patronize it, as it contains a history of every Lodge in the State.

On motion, the committe appointed at the annual commu- nication of the Grand Lodge in 1865, to report what Lodges should have their dues remitted, and for what years, was con- tinued.

Bro. J. G. Marler introduced the following resolution, which was adopted :

Resolved, That the dues of no other Subordinate Lodges be remitted until the committee appointed upon this subject report, and that said committee report without delay.

On motion of Bro. D. N. Sherwood, the vote by which the resolution remitting the dues of Mt. Moriah Lodge, No. 82, was adopted, was reconsidered ; and on further motion of Bro. Sherwood, the resolution was referred to the committee on that subject.

1st. A man worthy and well qualified, was elected to receive the de- grees of Masonry, and was iniated as an E. A. He then, in the discharge of his duty, received a wound that deprived him of his right arm. Is it proper and right to pass and raise him to the sublime degree of Master Mason ?

2nd. K man applied to be initiated into the mysteries of Masonry, by petition in the usual form, except that being unable to write his name, it is appended with his mark, and the Worshipful Master rejects the pe- tition, because the petitioner cannot write his name. Is the reason for the rejection of the petition a proper one ?

Bro. T. M. Gardner appointed Bro . F. G. Foster, his proxy for St. John's Lodge, Xo. 1, for the remainder of the present communication.

B: o. Gardner moved the appointment of a committee to take into consideration the disposition of St. John's College, and to report at the present communication. Agreed to and Bros. T. M. Gardner, J. Q. Jackson, W. M. Cocke, Jno. H. Whitfield and C. A. Cilley were desigrated as the committee.

Bro. J. B Neathery, from the committee on remission of dues of Subordinate Lodges, reported as follows :

" The committee to whom was referred the duty of enquiring what Lodges in this Jurisdiction were entitled to have their dues re- mitted and for what period, beg leave to make a partial report :

Franklin Lodge, No, 109, asks that the amounts which it paid for the years 1862, 1863, and 1864, be placed to its credit for future years.

The committee recommend that the petition of the Lodge be granted."

Bro. E. W. Lassiter, in pursuance of appointment at the Special Communication of the Grand Lodge on the 2d of Feb- ' ruary last, delivered the following address, on the life and char- acter of Bro. William T. Bain, deceased, late Grand Secretary :

Donald Bain was a native of Scotland, and immigrated to this country about the year 1780. In 1785, he was married to Francis Eliza Hall, in V\ ilmington, K 0. Mr. and Mrs Bain removed to Bladen county, K C, where the subject of this address, William T. Bain was born on the 11th of Kovember, 1793. The early death of Donald Bain, the father, made it necessary that the son William T , should be qualified for busi- ness as soon as possible : and he was placed under the guardianship of Wil- liam Warden of Fayetteville, with whom he lived until he could provide for himself. And after a temporary residence at Cheraw, in South Car-

olina, Wadesboro and Pittsboro, in this State, in 1833 he settled in VV^ake county, and married Miss Martha A. Hill, by whom he had six children, all of whom survive them but one.

His Masonic career commenced in 1820. During the winter cf that year he was made a Mason in Kilwinning Lodge, No, G4, Wadesboro, IST. C, and after his removal to Ealeigh, he affiliated with Hiram Lodge, No. 40, and was Secretary for several years to the Lodge.

In 1836 he was elected Grand Secretary to the Grand Lodge of the State of N. C, and held that position up to the time of his death, (with the exception of four years, when he declined re-election,) having filled the office for 2Q years, and was elected the twenty-seventh time, when the summons came which terminated his earthly career and forever dis- solved his connection with this Grand Lodge and his Masonic brethren here below.

During this long period, through years of severe trial for Masonry, he gave undoubted evidence of his integrity ; and stood as one of the land- marks to our order, exemplifying in his life and conduct the excellence of its tenets, and illustrating the beauty of that character which is adorned by the virtues of Masonry and piety of the Christian.

During the long period of his connection with this Grand Lodge, he received many testimonials of the esteem in which he was held by his brethren, and the appreciation of his services as Grand Secretary by t^e Grand Lodge.

The most recent one was the presentation of a Grand Secretary's jew^ el, by a unanimous vote of the Grand Lodge, upon the recommendation of the "committee on the Grand Secretary's books."

His address upon accepting the same is alike creditable to his heart and his understanding, and shows what strong fraternal regard he bore to his brethren, and what liberality of sentiment he maintained for his fellow men.

The highest degree in Masonry to which he attained was that of Select Mapter." Though his zeal for Masonry was unsurpassed, he was far from being an enthusiast. The most striking feature in the char- acter otour esteemed and lamented brother was philanthropy.- He was a sincere friend, and his warm and loving temper imparted its warmth to those around. As by the brook, freshness is given to the air and f erdance to the fields, so by the love of one heart, many others were inspired with love. They seemed to possess his ardor, to breathe his fervor, to become philanthropists themselves. The same sentiment is no less visible in the ardent and tender attachment shown to all the brethren. Masonry seemed to have attracted his attention, to have en- gaged his thoughts and absorbed his souL

Her interest was his ; her prosperity or adversity was his joy or sor- row ; he seemed to be glad, or mournful, to weep and rejoice with hen The same happiness attended his private life The cares of a family were made pleasures by love. Adversity in his public career, was re- lieved by happiness in private life, and the joy of prosperity was height- ened by domestic pleasures. The peace and quiet of home afforded a sweet interchange with the corroding cares and stirring scenes of pub- lic life, a rest from the troubles of the past, a refreshment for those of the future. There are few who can be useful in a large sphere. When the energies of man are concentrated upon one point, when one object ia pursued unwaveringly through life, it is almost inevitably gained.

Bro. Bain was a Mason nearly half a century, and during the larger portion of this time, filled honorable positions, with credit to himself and profit to the craft. In zeal and knowledge, perhaps no one in the State, excelled him. Upon kasonry next to religion he expended his time and talents. Here he sowed abundantly, and bountiful harvests have been his reward. He had the confidence and esteem of his brethren, and was known and respected by many others*,

He died lamented for his many virtues. The praises of men followed him to the grave, and he was met in heaven by the welcomes of angels. He had, during his life, gained the friendships of men, and it is natural that, at his death they should reward him with praises, that those whose hearts were united to his on earth, should de.-ire to follow him to heaven.

How sweet is that feeling of friendship which binds friends together whom the river of death separates, that fellowship of souls which causes I them, like kindred drops, to mingle into one. It is the chief source of toaa's happiness on earth and the perfection of bliss in heaven. No earthly strains are worthy of its sweetness It may be sung truly only in heaven, and by a celestial choir. This union of souls should be be- gun on earth, though its completion is reserved for a holier sphere. When we reflect how dear he was to others on earth, and how dear is his memory now, and wheii we compare such esteem as this with the fame of statesmen and warriors^ to whom we look up with astonish- ment, but not with love, who fill us with awe, but awaken no pleasing feeling, which character do we chink the most desirable ? The one is greatest in time, the other is greatest in eternity. But truly I doubt not that many would possess the friendship and esteem of others, rather than the obedience of millions, who concealed the bitterest enmity under fair words, and harbored mortal hate> in hearts which wore the guise of friendship.

While we reflect upon his character, we must confesss that such like

And when the time shall come, when the lion and the lamb shall lie down together ; when strength shall be no longer used for the des- truction, but for the protection of the weak ; when the feelings and virtues of angels shall inspire the breasts of mortals * when martial music shall no longer inflame the hearts of hostile armies ; and the spears shall be baaten into plough- shares; when shall spread her bright wings and virtues give their blessings to the world, Masonry may claim the honor of spreading this happiness throughout the earth.

Now, my brother Masons, having reviewed the virtues of our brother^ ere we dismiss them from our memory, let us treasure up what we may gather trom his life for the virtues of departed men may arouse the flame of virtue in the bosoms of those now living, and their greatness may produce kindred sparks in the hearts of others^

Let us learn from Jiim, who passed safely through life, to tread safely that dangerous path ourselves. Let us learn how virtue prospers in this life, while it is never unrewarded in the life to come. Let us learn to have a single aim on earth, a sure hope of heaven. Let us, as he did, cherish peoxe and union among ourselves, and Mnd closer the l)ond of friendship; so that when the sun shall cast his last rays over the earthy when his glory shall be eclipsed by the splendor of heaven, and the kingdoms of this world are enveloped in those of eternity, our bodies maybe purged from sin and death, and our souls reunited in heaven.

Bro. James Banks added some remarks in which he paid a handsome tribute to the memory of the deceased.

A communication from B'ro. J. O. A. Kellj, W. W. A. Jenkins, referred to the committee on Propositions and Grievances.

Besohed^ That tlie Grand Treasurer and Grand Secretary, under the direction of the Grand Master, be instructed to have the lower rooms of the Grand Lodge building properly renovated, and supplied with suit- able furniture for Committee Rooms.

Besolved, That the Grand Secretary be instructed to have his office in one of said rooms during the recess of the Grand Lodge, and that he have suitable book-cases made, and collect the Library of the Grand Lodge, and keep the same in his office, together with all other docu- ments belonging to the Grand Lodge under his supervision, and that the sum of $200 be appropriated for said purpose.

Bro. K. W. York introduced the following resolutions which were read, and on motion of Bro. W. A. Jenkins the considera- tion thereof was postponed for the present :

Whekeas, This Grand Lodge has adopted what is known as the " Stevenson icork^'* and this work having been receive d and highly ap proved by a large number of the most learned and zealous Masons in the State, and whereas, an opportunity is now presented, by which the work may be learned direct from Brother Stevenson, and thereby retained in all its purity, therefore,

Resolved^ That the Grand Master be, and he is hereby authorized to appoint a committee of three intelligent and prudent Masons, who shall upon accepting the office, proceed to learn the work directly from Brother Stevenson, and when, in his opinion, they have thormghly learned th« work, he shall give them a certificate to that effect, and the Grand Mas- ter shall then commission the said committee as Deputy Custodians of the work for North Carolina. This committee shall hold office respect- ively for three years, the term of one expiring at the close of each Masonic year, i. e. at the annual meeting of the Grand Lodge. The first ap- pointments to be made for one, two and three years, after that for three years each. In case a vacancy occur, the Grand Master shall fill the same by appointment, but in such case, the appointment shall be only to fill the unexpired term, and at the expiration of the term of of- fice, the vacancy shall be filled by the newly elected Grand Master during the session of the Grand Lodge, or as soon thereafter as practicable.

Resolved, That this committee shall have power to instruct and com- mission Lecturers ; but no one shall teach any other work, or assume to lecture Subordinate Lodges, without first being duly examined by said committee and obtaining their certificate of his qualifications for the position.

Resolved, That this committee shall receive no pay from the Grand

Lodge for their services as custodians of the work, but may regulate their

own terms with those who seek their instructions to become qualified for 3

Lecturers, and in like manner may the Lecturers regulate their own terms with Subordinate Lodges desiring their services.

Resolved^ That the G-rand Lodge pay Bro. Stevenson a satisfactory amount for instructing the Deputy Custodians of the work.

Resohed, That from and after this date, no brother shall exercise the duties of Lecturer, without first obtaining a certificate^ as provided in the above resolutions but any member of the committee of Deputy Cus- todians may exercise the duties of a Lecturer on the same terms and conditions as any other Lecturer.

Resolved, That the committee of Deputy Custodians shall be ex- officio members of the Grand Lodge during their term of office; and si; all be competent to hold ofl^ice in the Grand Lodge or any Subordinate Lodge.

Bro. T. M. Gardner introduced the following resolution :

Whereas, The committee on Charters and Dispensations at our last Annual Communication labored under a very great misunderstanding in regard to Stanhope Lodge, U. D., whereby its Dispensation was arrested and great injustice done to many good and true Masons, therefore,

Resolved, That the case of Stanhope Lodge be referred to a select com- mittee of three, and they be requested to report thereon as soon as possi- ble.

Bro. J. G. Ramsay, from the committee on Masonic Juris- prudence, submitted the following report which was read and made the special order for this afternoon at B o'clock :

To THE Most WoRSHtPFUL Grand Master op the Grand Lodgs of North Carolina :

The committee on Jurisprudence have considered the various matters referred to them and authorize me to make report as follows :

1. On the subjects of a Digest of Masonic law and the revision of the Constitution and By-Laws of this Grand Lodge, we recommend that ttie committee, consisting of the Grand Master, and Bros. Martin and Carr, . be continued, and that they complete and publish the Digest as soon as possible, and we recommend that the Constitution and By-Laws, as re- vised by that committee with the recommendations in their report be adopted.

2. On that part of the report of the Grand Secretary in reference to a violation of the jurisdiction of this Grand Lodge by Keith Lodge, No. 86, and Athol Lodge, No. 65, Kova Scotia, we are satisfied that the Grand Lodge of England is in no way responsible for the same : but those Lod- ges having transferred their allegiance from the Grand Lodge of Scotland to the recently constituted Grand Lodge of Nova Scotia, we recommend that the Grand Secretary be instructed to call the attention of the latter Orand body to this subject, expressing the hope and belief that every thing will be done by it, necessary and proper, to guard against like oc- currences in the future.

3. On the first subject referred to your committee, embraced in the report of the Grand Lecturer for the 5th Judicial Circuit, we recommend that the Grand Secretary be instructed to issue a special circular to the Mas- teis. Wardens and the Brethren of the Subordinate Lodges, calling spe- cial attention to the frequeat violation of Section 10., Art. IV. of our By- Laws which requires due proficiency, in each preceding degree, to be manifested in open Lodge, before the advancement of candidates, and requiring by the authority of this Grand Lodge, a strict and faithful ob- servance of this article.

On the second subject in said report we recommend that Black Rock Lodge, No. 135 be informed that this Grand Lodge is pained to learn that it has so grossly violated Masonic laws and courtesy, in conferring the degrees of Masonry on the petitioner under the jurisdiction of, and rejected by St. John's Lodge, No. 1, and that it is only because this Grand Lodge is induced to believe that nothing of the kind will occur in that Lodge in the future, that its charter is not revoked.

4. Overture No. 1, is as follows, viz : A man worthy and well qualified was elected to receive the degrees of Masonry, and was initiated as an E. A. He then, in the discharge of his duty, received a wound that de- prived him of his right arm. Is it proper and right to pass and raise him to the sublime degree of Master Mason ? Your committee report they arc of the opinion that it is not. Such a candidate is not, in the language of the ancient Oonstitutions "a perfect youth, having no maim or defect in his body that may reader him incapalle of learning the Ait, of serving his Master's Lord, and of being made a Brother, and then a Fellow-Craft in due time, &c." Overture No. 2. We have examined the By Laws of Mount Hermon Lodge, No 118 and Oleaveland Lodge, No. 202. We recommend that the By-Laws of Mount Hermon Lodge, be amended in Article fifth, Section second, by striking out the words suspended or expelled," and inserting "excluded from membership," also that section third of same Article be stricken out and that Article seventh. Section first, be so amended as to allow a mem- ber to withdraw at pleasure by paying all his dues to the Lodge, when in good standing. With these corrections we recommend their adoption by this Grand Lodge.

e recommend the adoption of the By-Laws of Cleaveland Lodge, No. 202, in Sec 6th of Art, 4th, by striking out the word suspended^ and in- serting the word excluded. We also recommend the adoption of the By- Laws of Person Lodge, No. 113, with a very slight amendment, and of Granite Lodge, No. 194, without amendment.

T he report having been read, on motion of Bro. W. A. Jenkins the same was concurred in, except the opinions of the committee on the overtures therein embraced.

Bro. E. A. Foe moved that the negative opinion of the committee upon the first overture be stricken out and an af- firmative inserted.

On this motion the yeas and nays by Lodges were called, which resulted yeas 173, nays 201.

On motion of Bro. W. A. Jenkins the word ''affirmative,^ the answer to the second overture, was stricken out and the word "negatM^ inserted.

The report as thus amended was adopted as a whole.

The committee appointed at the last annual communication

to procure the portraits of the living Past Grand Masters of

this State &c., submitted their report as follows :

To THE M. W. Grand Lodge op North Carolina :

The undersigned respectfully report that the duty assigned them un- der resolutions of the Grand Lodge passed at the last annual communi- cation, appointing the Grand Treasurer and Grand Secretary a commit- tee to procure the portraits of all living Past Grand Masters of thia State, has been performed.

It was ascertained that twelve Past Grand Masters were living, to wit: Bros S. F. Patterson, J. H. Wheeler, P. W Fanning, W F. Col- lins, A. T. Jerkins, C. H. Jordan, P. A. Holt, Alfred Martin, L. S. Wil- liams, W. G. Hill, E F. Watson and John McComick.

The portraits of these brethren, with that of the present Grand Mas- ter, were obtained.

The total cost of the work was $675, being $50 each for twelve and $75 for one.

We state in explanation of the difference in price, that after the first painting was executed, the rest were contracted for at $50 each.

So much of the resolutions as required the portraits of the Grand Masters from and including the year 1866, to be taken in life size in the regalia and chair of the Grand Master^ was not complied with, as the

cost of a painting of such size, would, in the estimation of the commit- tee, be more than the Grand Lodge contemplated.

The committee were of opinion further that uniformity in size and style would be more satisfactory to the Grand Lodge.

The committee hope that their action may receive the sanction of the Grand Lodge.

We recommend that the Grand Treasurer take up these notes as fast as the finances of the Grand Lodge will permit, and that in doing so, he give preference in first pay- ments to any widows and orphans of deceased masons who may hold such notes.

Palmyra Lodge, No. 147, sends up a note against the Grand Lodge for $50, with interest, and asks that the same be placed to its credit for annual dues. We recommend that the request be granted, that Lodge being in arrears for three years.

The committee have also examined the books and vouchers of the Grand Treasurer, and find that there was a balance on hand at last set- tlement of $320 55

M. W. E. G. Reade, Grand Master of the Grand Lodge of N. C. : M. W. Sir and Bro : It again 'becomes my duty to render an account of my labors to you, at the close of this Masonic year, as Lecturer for the second Judicial circuit of North Carolina.

In compliance with a resolution of the Grand Lodge at its last annual communication, I repaired to Wilmington May 15th, and remained until the evening of the 19th when it became necessary for me to return home, owing to sickness in my family. I remained at home until the 8th of July when I went again to Wilmington, and on the evening of the 10th, P. G. M., and State Grand Lecturer Alfred Martin gave me a cer- tificate of my proficiency in the work and Lectures of Masonry. Imme- diately on my return home I addressed a letter to the R. W. Robt. W. Best, Deputy G M., informing him that I was then ready to dispense the work to all who wished my services.

On the 12th of August, I commenced lecturing with Franklin Lodge,

No. 109, and lectured twelve days. I left some of the brethren much im- proved in the work. I shall ever feel grateful to the brethren of said Lodge for the kind and brotherly treatment that I received at their hands while laboring with them.

The records as kept by the former Secretary, I am sorry to say, were badly out of joint ; but am happy to be able to say the present Secretary has much improved them ; and I believe has the interest of the craft at heart

September 2nd, I commenced lecturing with the brethren of Joseph Warren Lodge, No. 92 whom I found very zealous and anxious to r&t> cieve the true work ; but owing to there being so much sickness in the neighborhood of this Lodge I had but few to lecture, of these I am hap- py to say I left the S. W. very near perfect in the work and lectures ; and most ot the others who attended were greatly improved.

Their records I found kept in a business like manner. I closed my la- bors with them on the 13th and they all expressed themselves well pleas- ed with the work of Bro, Martin.

I visited and spent the 14th with ISTahunta Lodge, No. 239. Some few slight errors in their records I corrected and left expecting to visit them again soon.

Septeniber 19th I commenced lecturing with the brethren of Rountree Lod^/j, No. 243. Here I found the brethren very anxious for the work, and they attended punctually, and I was pleased with their zeal. I lec- tured W'ith them six days. Their records are kept in a businesslike man- ner, and I think their charter is in good hands.

October 28th, I commenced to lecture with the brethren of St. John's Lodge, No. 96, but made very little progress before one of the officers re- fused to receive the w^ork, although they had previously passed a resolution unanimously calling me to lecture and instruct them in the work. I have made no further attempt to instruct them. They are far from having the work as taught by Bro. Martin. Their records are well kept

November 18th, I went to Trenton to lecture with Zion Lodge, No. 81 ; but there was some misunderstanding on the part of the Lodge as to my appointment, and I returned home without being able to see the re- cords, and the Meeting of the Grand Lodge being so near I could not meet the appointment of the Lodge,

I am well pleased with the work and lectures as taught by Bro. Alfred

Martin^ and all the brethren whom I have instructed expressed themselves

well pleased, and hope the Grand Lodge will adopt some means by which

to make it permanent and compel all the Lodges under its jurisdiction

to procure the same, that we may have uniformity.

The committee on Propositions and Grievances submitted their report as follows, which was read and concurred in :

The committee on Propositions and Grievances beg leave to report :

1st. That they have examined the appeal of Bro. J. A. Shelton from the action of Wm. R. Davie Lodge, No. 37 ; yithe case of Bro E. D. Hamp- ton, and recommend that the action of Wm. R. Davie Lodge be reversed and a new trial ordered.

2nd. Your committee having taken the question from Catawba Val- ley Lodge, No. 21T, under consideration, find upon examination of the resolution of the Grand Lodge passsed at its communication in 1851, that subordinate Lodges are restricted from initiating Ministers of the Gospel free of charge ; and hence Catawba Valley Lodge, No. 217 is not permitted to excuse Bro. Schutz from the payment of his fees under the suspension of the By-Laws, of the 3rd of May, 1865.

3rd. In the case of iMocksville Lodge, No. 134 vs. Wilborn Stone- street, they find that a Bro, after being expelled, and the expulsion con- firmed by the Grand Lodge, may be restored by a unanimous vote of the Lodge so expelling him. We therefore recommend that Mocks- ville Lodge, No. 134, be instructed to restore Bro. Stonestreet, if, in its judgment, he is worthy.

4th. That in the case of Orr Lodge, No. 104, m. Skewarkee Lodge, No, 90, we are satisfied from the evidences before us, that Skewarkee Lodge, No, 90, has acted in violation of Masonic Law and usage, and recommend that it be suspended until the next annual communication of this Grand Lodge.

5th. In the case of D. H. Dill, from Orr Lodge, No. 104, your com- mittee recommend that the Lodge be allowed to restore him.

6th. In the case of A. L, Stowe, and Frank Cradle from Orr Lodge, Nc. 104, your Committee know of no remedy.

7th. In the case of Cokesbury Lodge, No. 235, against McCormick,

No. 228, your committee recommend that the proceedings of the Grand

Lodge of 1866, be reversed.

That after examining, with care, all the testimony bearing upon the case, your committee are satisfied that the committee of last year did their duty in taking from said Lodge its Dispensation, as they had vio- lated Masonic usages ; but after hearing patiently, all the circumstances connected with the case, we are thoroughly satisfied that their action was an error of the head and not of the heart that what they did was for want Masonic of light. As the members of Stanhope Lodge are good and true Masons, and seem desirous of learning and faithfully practicing our noble art, we would therefore recommend the adoption of the following resolution, to- wit :

On motion of Bro. R. W. York, the following resolution adopted at the Annual Communication of this Grand Lodge 1865, was repealed :

" Hesohed, That the officers of all Military Lodges lately working un- der charters or dispensations from tMs Grand Lodge, are hereby directed to surrender to the Q-rand Secretary all their books and papers, and that from said certified records the Grand Secretary shall furnish to each member of said Lodges a certificate of membership, and where such books or papers have been unavoidably lost or destroyed that the Secre- tary may furnish a list of members certified by the Master and Wardens."

Ordered^ That an allowance of two hundred dollars be made to the Grand Secretary as compensation for services for the year 18G8, in addi- tion to the salary provided for in Sec. 4th of Art. 3d of the By-Laws of the Grand Lodge.

Resolved^ That the Grand Secretary be instructed to call the attention of the subordinate Lodges to the 18th section of the 4th article of the By-Laws as amended by this Grand Lodge, and warn them that any in- fraction thereof will be punished by the revocation of the charter of any Lodge which shall disregard it.

After some discussion the question was taken on the resolu- tion and decided in the negative.

Brethren : Your committee to whom was referred the report of Bro. L. L. Stevenson, Grand Lecturer for the third Judicial Circuit, beg leave to report that they find after diligent inquiry,that Brother Stevenson inter- preted a letter of Past Grand Master, Alfred Martin, which recommended *bim for the appointment, to be a certificate of qualification, while Bro. Martin simply intended said letter to be nothing more tban a recom- mendation to the appointment. The Deputy Grand Master on being in- formed by Brother Stevenson that a certificate had been granted to him, did issue a commission to Bro. Stevenson authorizing him to lecture.

We are therefore of the opinion that the repart of Brother Stevenson should be received and adopted without any censure. ^

Resolved^ That the Grand Lodge of North Carolina extends a fraternal recognition to the Grand Lodge of Kova Scotia, and a cordial welcome' into t^e sisterhood of Grand Lodges on the continent.

The following is the final report of the committee on Char- ters and Dispensations embracing^ in condensed 'fo?m, all re-' ports submitted during the session and adopted. To THE M. W. Grand Lodge oe North Carolina:

The Committee on Charters and Dispensations beg leave to recomnyend that Charters be granted to the following Lodges IT. D., to wit : Excel- sior, High Brighton, Gaston, Coble, Farmington, Durbin, Dunn's Rock, Unaka, East Bend, Builder's, Tabasco, Mebaneville, Watauga, St. Pat- rick's, Manuel Fetter and Beaver Dam,

The Committee recommend that the petition of sundry members of Mecklenburg Lodge, No. 176, for the restoration of the charter of that Lod^e and the remission of dues for the years during which it was dor^ mant, be granted.

The committee also recommend the restoration of the Charter of Wes- tern Star Lodge, No. 91, with advice to approve their proceedings l>efore closing the Lodge, and that all meetings of the Lodge should be open- ed and closed in the Master's Degree.

The Committee regret that they cannot recommend the granting of charters to the following Lodges U. D., to wit: Colesville, Green Level, Clay and Blue.

The labors of the committee have been very onerous, By-Laws and proceedings have been thoroughly examined. A rigid investigation has preceded every decision.

With a sincere desire of aiding in the great and glorious work of in- creasing the wisdom, strength and beauty of our Ancient Institution, our report is respectfully submitted.
